From my perspective, government should be able to ignore the power of the Provincial Courts to pass their legislation. I believe that it gives elected officials the flexibility they need to pass legislation that advances public policy objectives, particularly in situations where the government's intentions and the courts reading of the law differ. Moreover, it maintains the idea of legislative supremacy, allowing elected officials to act in the interests of the people they represent. On the other hand, the Notwithstanding Clause challenges the goal of a constitution, which is to protect individual rights from government power. On this side, I think it harms the separation of powers and the rule of law, which could result in abuse of authority and violations of citizens' rights.
